Davis-Stirling Act

The Davis–Stirling Common Interest Development Act establishes a unified statutory framework that regulates all types of common interest developments, including Property Owners Associations (POAs) like the one that governs California Pines.

EFFECTIVE DATE:  The Act was authored by Assemblyman Lawrence W. Stirling and enacted in 1985, seventeen years after the POA was first established.  Since the POA was formed under common interest law that pre-dated the Davis-Stirling Act, some of the provisions of the Davis-Stirling Act do not apply to the California Pines POA.

CONTENT:  Among other things, the Davis-Stirling Act sets requirements for public notice and delivery, annual reports and disclosures, conflict of interest, insurance and liability, the use of common areas, liens, and dispute resolution and enforcement.
